Murray Birrell were appointed to advise on a leaking basement to a new building in Clavering Place, Clapham Common. The building had been constructed with a new basement but it was apparent that dampness was occurring at low level throughout the basement. An investigation revealed that the basement was leaking and the insulation below the ground floor finishes and above the basement tanking had flooded.

Overview

On our advice lawyers were appointed, negotiations proceeded with the developer and it was agreed to carry out remedial works. However, in the subsequent winter, water levels rose, (the property is in the valley of one of London’s lost rivers, the Falcon), and further tanking works were required as a result. It was apparent that workmanship on the basement was not satisfactory and, following legal representations, a comprehensive repair system was put in place on the advice of Sika.
